Comments on the Proposal of the European Commission for a Directive on representative actions to protect the collective interests of consumers

In the opinion of the German Banking Industry Committee (GBIC), there is no need for a European initiative to introduce representative actions to protect the collective interests of consumers. It is the responsibility of each Member State to implement their national procedural law in such a way, that consumers have access to effective remedies. The draft Directive represents a significant intervention in the German law of civil procedure and ignores basic fundamental rights in many areas.
